JOBIGO AI – TERMS OF SERVICE

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Jobigo AI software platform, mobile applications, AI voice and SMS systems, dispatch automation, payment tools, and all related services (collectively, the “Services”) provided by Jobigo AI (“Jobigo AI,” “we,” “our,” or “us”).
By creating an account, accessing, or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Services.

2. Eligibility & Account Registration

You must be at least eighteen (18) years old and have the authority to enter into these Terms on behalf of yourself or the business you represent.
You agree to provide accurate account information and keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

3. Description of Services

Jobigo AI provides a business management platform designed for locksmith and field-service companies.
The Services may include:

AI voice agents and SMS systems
Customer job creation and communication
Technician dispatching and GPS tracking
Payment processing and invoicing
Evidence storage and dispute-prevention tools
Technician mobile applications
Inventory and business management tools
Data reporting, analytics, and workflow automation

We may update, improve, or modify the Services at any time to maintain or enhance functionality.

4. User Responsibilities

4.1 Use of the Services

You agree to use the Services only for lawful, legitimate business purposes.
You must ensure all submitted information—customer details, prices, invoices, photos, job data—is accurate and compliant with applicable laws.

4.2 Technician & Employee Use

You are responsible for ensuring that technicians, dispatchers, managers, or any user on your account comply with these Terms.
Any action taken by your team is considered authorized by you.

4.3 Customer Communications & Compliance

You acknowledge responsibility for complying with communications laws, including consent requirements for recording calls, sending SMS messages, or storing customer data.
Jobigo AI provides tools but does not provide legal advice.

5. AI Voice Agent and Automated Decision-Making

The Services may include automated decision-making, such as assigning technicians, responding to SMS messages, estimating arrival times, or generating job summaries.
You agree that:

The AI agent may make decisions based on available data
You are responsible for reviewing and may override assignments
Jobigo AI is not liable for errors caused by inaccurate or incomplete data

6. GPS Tracking and Technician Location

When enabled, the mobile app collects real-time location data while in use.
You agree to notify technicians and obtain consent where required.
Jobigo AI is not responsible for how your organization uses such data.

7. Payment Processing

Payments are processed by third-party PCI-compliant providers such as STAX, Payrix, Stripe, or others (“Payment Processors”).
By using payment features, you agree to the Payment Processor’s terms.

7.1 Fees & Merchant Rates

You agree to pay subscription fees, processing fees, and other charges.
Fee changes will be communicated in advance.

7.2 Chargebacks & Disputes

You are responsible for chargebacks and providing evidence.
Jobigo AI provides tools to store invoices, photos, signatures, and job notes but does not guarantee dispute outcomes.

8. Content and Data Ownership

8.1 Your Data

You retain ownership of job data, photos, messages, and content you upload (“User Data”).
You grant Jobigo AI a limited license to process User Data solely to operate the Services.

8.2 System Improvements

We may use aggregated, anonymized data to improve algorithms, dispatch logic, performance, and platform reliability.
Aggregated data cannot identify you or your customers.

9. Restrictions

You agree not to:

Reverse-engineer, copy, or modify the Services
Use the Services for unlawful or fraudulent purposes
Resell or sublicense the platform without written consent
Interfere with system security or access unauthorized areas
Use automated scripts or bots not provided by Jobigo AI

Violation may result in immediate account suspension.

10. Service Availability

We strive for reliable access but do not guarantee uninterrupted operation.
Maintenance, outages, or third-party failures may occur.
Jobigo AI is not responsible for delays caused by carriers, networks, or service providers.

11. Termination

We may suspend or terminate your account for violating these Terms or threatening platform security.
You may terminate your account at any time by contacting us.
Certain data may be retained as required by law.

12. Disclaimers

To the fullest extent permitted by law:

The Services are provided “as is” and “as available”
We disclaim all warranties, express or implied
We do not guarantee error-free, secure, or uninterrupted operation
We are not responsible for decisions made by users, technicians, managers, or AI automation

The platform assists your business, but final decisions remain your responsibility.

13. Limitation of Liability

To the maximum extent permitted by law, Jobigo AI is not liable for:

Indirect, incidental, consequential, or punitive damages
Lost revenue, customers, or opportunities
Data loss, communication delays, missed updates
Technician behavior or incorrect job assignments
Errors caused by payment processors, carriers, or mapping tools

Total liability shall not exceed the amount you paid Jobigo AI in the previous three (3) months.

14. Indemnification

You agree to indemnify and hold harmless Jobigo AI, its officers, employees, partners, and affiliates from claims, losses, liabilities, or expenses arising from:

Your use of the Services
Data you submit
Actions of your employees or technicians
Violations of these Terms
Violations of applicable laws

15. Governing Law

These Terms are governed by U.S. law and the laws of the state where Jobigo AI is headquartered.
Disputes will be resolved in courts within that jurisdiction.

16. Changes to These Terms

We may update these Terms periodically.
The “Effective Date” will be updated accordingly.
Continued use of the Services indicates acceptance of the new Terms.
